Custom Vacations, Itineraries, and Trips

These Custom Curated Itineraries include but are not limited to vacations specifically and solely planned for your known group or individual travel. 


Explore God's Creation, LLC offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Explore God's Creation, LLC does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, you, the traveler and client, agrees that Explore God's Creation, LLC and its agent acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing, and other privileges, or services for the clients' benefit, and on the express condition that Explore God's Creation, LLC shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection there with.

Travel Expertise

Explore God's Creation, LLC completes regular training and research concerning the travel industry. We provide our expert knowledge as advice and recommendations for your vacation. When a travel delay or issue arises, we will be your advocate through the process. However, it is the client's sole responsibility to make decisions in your best interest. When acts of God or terrorism or issues that arise out of our humanly control, you hold harmless Explore God's Creation, LLC and its agents from liability. 


Explore God's Creation, LLC and its agents function solely as the booking agent, and not the supplier. The supplier is solely responsible for their action and inaction. 



Vacation 

Explore God's Creation, LLC's Vacation Planning Fee includes researching, planning, and curating a custom vacation plan for each individual trip. Our services also include assisting you throughout your trip.



Pricing

Prices quotes are subject to change without the submission of a deposit to lock in a package rate and are based on availability. In some situations, a deposit or payment plan is not available, and aspects of the trip must be paid in full in order to lock in the current market pricing. 


All monies authorized through Travefy are applied directly to the partner travel supplier responsible for fulfilling your trip. 


In regards to airlines and flights, Explore God's Creation, LLC is not a ticketing agency for any brand of airline and does not represent them. If you experience flight cancellations, delays, or baggage delays, Explore God's Creation, LLC is released from any liability in regards to compensation. Compensation that you are due are the sole responsibility of the airline your vacation is fulfilled through. 



What To Expect

Upon submission of the Vacation Planning Form, the agents of Explore God's Creation, LLC will contact you to acknowledge your submission and request more information. The more information you are able to provide about your vacation, the better we are able to serve you and provide a comprehensive itinerary. If you haven't decided on key pieces of your trip, then we won't be able to fulfill your vacation quote. 


Agents of Explore God's Creation, LLC will provide one quote with a comprehensive vacation plan. This quote is subject to change at the travel supplier's discretion. No pricing is locked in without a direct deposit from you to each and every travel supplier. Sometimes multiple travel suppliers are used to meet any budgetary restrictions. 


You are allowed a maximum of 3 minor itinerary changes before you would be subject to an additional vacation planning fee in the form of a minimum of $50. This additional charge can vary depending on the details of the itinerary change and at the full discretion of agents at Explore God's Creation, LLC. Minor itinerary changes include declining or adding a travel component within reason. Major itinerary changes include, but are not limited to location changes which warrants additional and new research, and change in the mode of transportation to your vacation destination(s).


  1. Agent for Suppliers: Explore God's Creation, LLC ("Explore God's Creation") acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation ("Supplier"). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.
  2. Risks of Travel and Release: We assume no responsibility for and shall not be liable for the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
  3. Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier rules, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.

    4. Other Foreign Entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

    5. Fees and Price Drops: You agree to pay the travel planning, change, and other fees at www.abctravel.com/fees. All of our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

    6. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

    7. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

    8. Credit Card Merchant: We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

    9. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in [county name, state name] will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those court

    Please note that if you decide to not sign this agreement or use our services, then we have the right to refuse to provide any further advice for your upcoming trip. 


EVERY FAMILY OR PARTY MEMBER 18 AND OVER MUST SIGN. 



Post-Booking Waiver for Custom Vacations

Waiver to Verify You Have Proper Documentation Needed For Your Vacation

You acknowledge that it is your responsibility to ensure you have all the proper documents for your vacation (passports, visas, etc) and vaccinations. You also understand you must meet all other entry requirements for your chosen vacation destination(s). This may include passing a background check for the travel supplier and/or country of destination. 


County entry rules change often, and we will try to keep you updated on current requirements for your destination. However, ultimately, it is your responsibility to remain compliant with all entry requirements for the destination countries on your tour itinerary. 


DOCUMENTATION: U.S. Citizens traveling to any destination outside of the United States will be required to present a valid U.S. Passport. Passports must be valid for at least 6 months beyond the return date. Some countries require a Visa for transit or entry. Passengers are responsible to ensure that they have all the proper documents for entry. All names on documents must match the legal name on your photo identification, and travel document information must match tickets. Please check the U.S. State Department website at https://travel.state.gov for further information. Immunizations may also be required. Failure to comply with these regulations may result in denied boarding, denied entry, and/or government-imposed fines. If you are a citizen of another country, there may be additional requirements. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens.

Please check all information upon receipt and verify all information is correct. Explore God's Creation, LLC will not be responsible for omissions or errors if not brought to my attention immediately. Payment must be received by the due date to avoid vendor cancellation.

Airlines, airfare and ticketing

Any and all air ticket contracts are between you, the passenger, and the airline. Explore God's Creation, LLC is not the merchant of record for airline transactions.

Tour Obligations and Risks

There are several assumed and inherent risks any time you travel, even within your local and familiar area: your access to medical facilities may be limited; become ill or sick with a virus; need to be quarantined; encounter roads and other infrastructure that you may not be accustomed to; your personal health insurance may not cover costs in a foreign country; you may experience travel delays and baggage delays; foreign languages may provide difficulty when navigating in country; your personal belongings are your sole responsibility while traveling on vacation; etc. These assumed and inherent risks are your sole responsibility and Explore God's Creation, LLC and its agents are not liable for these associated inherent risks.

Any pre-existing physical, mental or emotional condition that may require attention or treatment must be reported before the beginning of a tour. Omitting important information or not submitting these may result in expulsion from a tour at your own expense.

Smoking, Vaping, Tobacco, and Alcohol

Smoking, Vaping, Tobacco, and Alcohol is not allowed when with the group.

Privacy Policy

This Privacy Policy applies to information we collect about you when you use our website, any mobile app that we offer, and social media that we participate in.


We Personal Information Do We Collect? 

We collect your personal information (and that of your travel companions) that is provided to us either directly by you, your employer, or your travel sponsor, as applicable, in order to provide you with the products and services you have requested. In most cases, it consists of your full legal name, address, email address, phone numbers, and credit card information. We may also collect your employer or sponsor's name, passport number, driver’s license or other government-issued identification number, date of birth, gender, arrival and departure locations and times, airline, hotel or car rental frequent loyalty numbers, seat preferences, known traveler and global entry number, and other related travel information.


Information We May Collect Through Automatic Data Collection Technologies

We may collect other information, such as your IP address, search terms, and site pages when you visit us online. The technologies we use for this automatic data collection may include cookies and log data. We may use Google Analytics, which collects the cookie data. Go to https://policies.google.com/technologies/partner-sites for an explanation of how it collects and uses data. By using our website, you consent to our use of cookies.


We may also use IP addresses to identify a visitor when we feel it is necessary to enforce compliance with our website’s Terms and Conditions, or to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our website, or other users.


How Do We Use Preference Based Advertising, Analytics, and Services?

We do not currently share your information that we collect for preference-based advertising purposes and we do not currently have any plans to do so.


Who Do We Share Your Information with and Why?

Travel Suppliers: We share your personal information as necessary with airlines, cruise lines, hotels, car rental companies, and other providers for whose services you have requested our assistance. We enter this information in the Global Distribution System (GDS), which passes it on to the travel suppliers.


Email Communications: We may share your email contact information with our partners to assist with marketing our products and services. You may unsubscribe from receiving future commercial email communications from us by clicking the “unsubscribe” link included at the bottom of any marketing emails. However, we reserve the right to send you transactional emails such as customer service communications in connection with the products or services you have purchased.


Transfer of Assets: We do not sell or lease personal information or provide a list of our customers to third parties. However, if another entity acquires us or all (or substantially all) of our assets, the information we have about you will be transferred to and used by this acquiring entity. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.


Other Sharing: We may also share your information to protect and defend our rights and property.


Your California Privacy Rights

List of Third Parties: If you are a resident of the State of California, you may obtain a list of all third parties to which we have disclosed certain personally identifiable information as defined under California law during the preceding year for third party direct marketing purposes, if any. You may request the information in writing at privacy@abctravel.com.


Corrections: If wish to make corrections to any personal information you have provided, contact us at privacy@abctravel.com.


Do Not Track Disclosures: We do not take any particular action based on browser based Do Not Track (DNT) Notices; nor do we track your use of other websites.


Changes to This Policy: We may from time to time make changes to this Privacy Policy to reflect changes in legal or regulatory obligations or changes in the manner in which we deal with personal information. We will post any revised version of this Privacy Policy on our website. Any changes will be effective on the effective date stated in the revised Privacy Policy. If there are significant changes, we may provide more prominent notice or obtain your consent, if required by law.



PARTICIPANT RELEASE AND AGREEMENT

I, THE UNDERSIGNED (OR MY PARENT OR GUARDIAN IF I AM A MINOR), AN APPLICANT FOR A TOUR PROVIDED BY EXPLORE GOD'S CREATION, LLC (HEREINAFTER REFERRED TO AS EXPLORE GOD'S CREATION), AGREE TO THE FOLLOWING:

  1. I, the traveler, UNDERSTANDS AND VOLUNTARILY ASSUMES the risks, both known and unknown, associated with the trip or activity.
  2. I, the traveler, RELEASE, DISCHARGE, COVENANT NOT TO SUE AND HOLD HARMLESS Explore God's Creation, its owners, officers, agents, representatives, related entities, staff members, tour directors, employees, successors, and assigns for any claims that I may have arising from, or in connection with, any physical or property damage or other loss than I may suffer from any cause whatsoever other than the gross negligence of such persons. Without limiting the generality of the foregoing, I release such persons from and agree not to sue such persons for, any damages that I may suffer from any injury, loss, damage, accident, delay, or expense resulting from events beyond their control, including, without limitation, acts of God, weather, war, pandemics, strikes, incidents of politically motivated violence, terrorist attacks, sickness or quarantine, government restrictions or regulations, and, in the absence of gross negligence, arising from any vehicle, or from any act or omission by bus or car rental agency, steamship, airline, railroad, taxi or tour service, hotel, restaurant, school, university, or other other firm, agency, or company, or individual. 
  3. If any flights are included with my tour, I understand that the air carriers' liability for loss or damage to baggage or property, or for death or injury to person, is limited by their tariffs and/or the Warsaw Convention and related agreements. Further, I understand that the air carriers assume no responsibility to any traveler aside from their liability as common carriers. Furthermore, I understand that if the air carriers delay or cancel my flights, that all refunds, travel credits, vouchers, etc. are the sole responsibility of the air carrier to produce to me in a reasonable time and manner. 
  4. Explore God's Creation, its employees, officers, directors, agents, and assigns (collectively known as Explore God's Creation) does not own or operate any entity which is to or does provide goods or service for your tour. It purchases transportation (by aircraft, couch, ferry, train, vessel, or otherwise), hotel or other lodging accommodations, restaurants, ground handling, and other services from various independent contractors. As a result, Explore God's Creation is not liable for any negligent or willful act of any such person or entity or of any third party. In addition and without limitation, Explore God's Creation is not responsible for injury, financial or physical loss, death, or inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, pandemics, acts of war, civil unrest, insurrection or revolt, animals, strikes, or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, computer system failures, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. 
  5. Please check the attached information upon receipt and verify all information is correct. Explore God's Creation, LLC will not be responsible for omissions or errors if not brought to my attention immediately. Payment must be received by the due date to avoid vendor cancellation.
  6. I will assume full responsibility for my safety and actions while away from the group, such as visits to friends or relatives, or during stay-ahead/stay-behind optional periods if the optional period does not include the services of an Explore God's Creation representative. 
  7. If I become ill or incapacitated, Explore God's Creation and its employees, or my Group Leader, may take any action they deem necessary for my safety and well-being, including securing medical treatment (at my own expense) and transporting me home. 
  8. I agree to abide by all local laws when abroad, including those concerning drugs and alcohol. I understand that to abuse or disobey such laws is to waive the right to a refund of any part of my vacations and related fees and that Explore God's Creation may then send me home at my own expense. I also understand that should local authorities be involved, I will be subject to the laws of the country I am visiting. 
  9. I understand Explore God's Creation is in no way responsible for or connected to air carriage to and from my vacation destination(s). If Explore God's Creation arranges air carriage it is only as a courtesy and not an element of my Explore God's Creation vacation.
  10. I understand that I will be required to pay for any phone calls or incidental personal expenses that I incur at hotels, as well as for any damage I cause to hotel rooms, buses, ferries, trains, or cruise ships. I will indemnify Explore God's Creation and hold it harmless for any financial liability or obligation which I personally incur, or injury or damage to the person or property of others which I cause or contribute to while participating on an Explore God's Creation vacation.
  11. I assume and understand that there is a risk involved with my travel and my travel activities and/or excursions. I acknowledge that I was informed about my options and have been offered travel insurance.
  12. Explore God's Creation reserves the right to refuse or cancel any enrollment at its sole discretion. 
  13. I understand that future Explore God's Creation advertising and publicity material may include statements made by participants or their video clips or photographs, and I consent to such use of my comments or photographic likenesses. 
  14. This agreement shall be governed in all respects by the laws of the State of Florida. Any claim or dispute arising hereunder shall be filed in a court with competent jurisdiction in Leon County, Florida. If a claim or dispute arising under this agreement is made against Explore God's Creation, then Explore God's Creation shall be entitled to reasonable attorney fees (including, but not limited to, pre-suit, post-suit, collection, and appellate fees) plus all cost from the undersigned. 
  15. This agreement shall inure to the successors and heirs to the parties to their agreement. This agreement shall not be assigned without the written consent of Explore God's Creation. 
  16. This agreement constitutes the entire agreement between Explore God's Creation and me with reference to the subject matter referred to herein, and I understand that no warranty or representation not herein, including but not limited to any oral statements made to me by agents of Explore God's Creation applies to any Explore God's Creation vacation. This agreement may be amended or modified only in writing, signed by an Explore God's Creation officer at Explore God's Creation's main office in Tallahassee, FL. 
  17. In the event this agreement is signed by a parent/guardian of a minor, it shall bind the parent/guardian and minor to the terms of the agreement. 
  18. I hereby verify that I have reviewed my travel itinerary. I have been advised of all applicable fees imposed by Explore God's Creation, LLC and the suppliers, plus I have been offered the option of purchasing trip cancellation/interruption insurance. I understand that discounted fares and vacation packages typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.
  19. I hereby designate Explore God's Creation, LLC and its agents as my authorized proxies for any travel transactions as it relates and for this vacation, including agreeing to a travel suppliers' terms and conditions, agreements, etc.
